Ellad is committed to helping his clients resolve their business and tax disputes through strategic and effective advocacy.

Ellad Gersh is a partner in our litigation group. His practice is split between commercial litigation and tax litigation. Ellad’s extensive litigation experience and business background provides him with the tools necessary to help his clients navigate through their business or tax related disputes and achieve certainty through negotiated settlements.

Where these disputes cannot be settled, Ellad has the skill set and courtroom experience to advocate and produce results for his clients in Court.  

Within his commercial litigation practice, Ellad has an active construction litigation practice in which he represents municipalities, condominium corporations, and other owners in construction litigation matters including defending construction liens and advancing claims for construction deficiencies on their behalf.

Ellad’s other main practice areas within his commercial litigation practice also involve contractual and real property disputes, including representing landlords and tenants alike in commercial leasing disputes, representing developers and condominium corporations in condominium law related disputes, and enforcing mortgages on behalf of lenders.

Ellad has appeared at all Ontario Court levels and the nature of his business law practice lends itself to regular appearances on the Commercial List in Toronto, Ontario. He also has significant experience in alternative dispute resolution, appearing regularly before mediators, arbitrators, and administrative tribunals, including the License Appeal Tribunal and the Builder Arbitration Forum.

Within his tax litigation practice, Ellad primarily represents closely held private corporations and individuals in their tax disputes with Canada Revenue Agency before the Tax Court of Canada. Ellad is highly successful in achieving out-of-court settlements for his clients in their tax appeals, including in cases involving the denial of valid business expenses, the assessment of shareholder benefits, or director’s liability against owner/managers and assessments of CPP/EI against employers in independent contractors/employee cases. 

Ellad received his Bachelor’s of Business Administration (BBA) at the University of Toronto and his JD from Osgoode Hall Law School and completed Parts 1 and 2 of the CICA Tax Course.

Outside of work, he is a family man, a proud husband and father of 4 boys and active member of his Thornhill Woods community.
