Overview
Irving Marks represented the developer against the City of Toronto. The developer had assembled a large site at a prominent intersection, consisting of three existing midrise rental apartment buildings, for redevelopment as a condominium. The developer applied for a demolition permit and a building permit which the City of Toronto improperly refused to issue. Successfully obtained a mandatory injunction, upheld on appeal to the Court of Appeal, requiring issuance of the permits, which ultimately was enforced against City Council by a contempt order.
