Overview
The plaintiff brought a motion returnable July 24, 2008, in Milton, Ontario, seeking summary judgment against the defendants. The plaintiff’s claim was made pursuant to a mortgage between the plaintiff and the defendants. The allegation was that the defendants were in default and as well the mortgage had matured and was due and payable. The further allegation was that in what might politely be called a bare bones statement of defence, no genuine issue requiring a trial was raised.
