Overview

660 Sunningdale GP Inc. v. First Source Mortgage Corporation, 2024 ONCA 252  - Successfully overturned a lower court decision at the Ontario Court of Appeal, recovering a substantial mortgage commitment fee for the lender when the borrower abandoned the transaction in favour of a different lender. We previously forced the borrower to secure the fee at the outset of the litigation, ensuring that it was collectable when the court awarded judgment.
